Why We Win
Litigation is a Contact Sport
- Attitude/Winning Mindset. Winning at law involves a total commitment on the part of the lawyer you select to do everything within the bounds of law – for as long as it takes- to secure you the highest award conceivable.
- Experience/Real Trials not just paper pushing! Even with a warrior attitude your lawyer has to be battle hardened and comfortable and cool-headed in the Courtroom. Trials can be nasty. Games and maneuvers abound with lawyers pushing their advocacy to the very limit of the law. Your lawyer better know them and be willing to fight. And fight smart. One example should suffice – assume you’ve just heard a question from opposing counsel that’s likely to illicit damaging testimony. Do you object? Yes? No? If you do object you’re sure to highlight the problem even for those jurors who were napping- especially if the Judge overrules your objection. If you object and the Judge sustains you’re objection you get to keep the damaging evidence out and the jury never hears it. What do you do? When do you hold your fire? When do you unload? Only decades in a courtroom will build that trial reflex allowing you to make the right call instantaneously. You can’t learn it in a book.
- Resources to fight to the bitter end. Litigation and trials are very expensive. It’s not unusual to spend tens of thousands of dollars and even 6 figures to make sure your case is properly prepared, i.e., getting the best experts, exhibits, medical records reviewed, and PowerPoint presentations assembled. Many lawyers are reluctant about investing in cases preferring to make a few calls in the hope of a quick settlement. That’s not the way to maximize a case’s value. The insurance adjuster is neither blind nor dumb. If they see that the lawyer is scrimping they respond accordingly knowing that your lawyer is only willing to go so far and push so hard. Its human nature and economics 101. Your lawyer needs to be prepared to go deep into his/her pockets if they really believe in your case.
- Track Record. The insurance company and their lawyers have to know who your lawyer is and what he’s done in the past. Is he a “settling lawyer” or a “trial lawyer”? They research the public Jury verdicts and match it with your lawyer’s name. How much will this cost them when they are convinced that your lawyer will take it all the way to trial if you have to? How much will it cost them after a jury returns a verdict in your favor similar to what your lawyer just got in a similar case? They check and they know who’s who. So should you.
Bottom line: You need a lawyer who’s willing to break a sweat and keep sweating and not merely schmooze with the insurance adjusters. True a lawyer is likely to get a much quicker settlement by making a few phone calls and writing a letter or two but as the client you’re likely to pay for that. The insurance company won’t pay extra unless the lawyer does extra.
Its human nature 101.
