The Effective Use of Legal Experts
Nearly every serious case will require the use of one or more experts. Most treating doctors are reluctant to get involved. Fewer are willing to come into court on your behalf. Not surprisingly in order to build your case and demonstrate the severity of your injuries we have to retain experts who are willing to come into court and testify on your behalf. Given the real world we live in these experts have to be not only well credentialed but also good communicators. The two do not necessarily go hand-in-hand and I have seen otherwise righteous cases falter due to the legal/verbal inexperience of an otherwise highly qualified doctor.
The same applies in every other field of expertise whether that be accident reconstruction, highway maintenance, product safety, economics and wage loss analysis, vocational and occupational rehabilitation, etc.
The defense– funded almost always by an insurance company– has legions of experts only too willing to testify that the injured party isn’t so injured and can easily and readily go back to work, needs very little in terms of future assistance and probably caused the accident by his or her own negligence or made it worse. In truth this is the most abused aspect of litigation ripe for abuse. After 42 years I have found that if they pay an expert enough money he’ll tell you that the moon is made out of cheese and they’ll offer you a bite.
Accordingly, we are forced to play the game as well and over four decades I have established close relationships with very prominent doctors and other experts who are not only well-qualified but also familiar with how to effectively communicate. They know the drill. I’ve personally schooled them in the art of effective trial testimony.
