Muni Accidents

Bay Area Muni, BART and Public Transportation Accident Lawyers

Committed to Maximizing Your Financial Recovery Following Serious Injury

The Bay Area Municipal “Muni” Railway has faced as many as 3,600 injury claims in just a two-year period. At The Law Office of Ian Zimmerman, we ask the question “are public transportation employees using adequate care in the Bay Area?” When they don’t, we hold them accountable. We handle many of the injury claims that arise from negligence in these transportation systems. We have handled Muni, BART and other California public transportation claims, including claims involving:

  • Pedestrians who were hit by buses
  • Vehicles that were hit by buses
  • Bus stops and injuries
  • Travelers who were injured while riding buses
  • Inattentive drivers
  • We even represented a client who was dragged by a bus, and whose screams were ignored by the bus driver

While drivers of cars have a duty of “ordinary care” to others, “common carriers” such as bus drivers have a higher duty of care. The law, stated in a standard jury instruction, states “The care required of a common carrier is the highest that reasonably can be exercised…” When drivers fail in their duty, we are ready to provide experienced help.

In a recent case, a client was struck in a crosswalk by a Muni bus and suffered a complete rotator cuff tear. During settlement negotiations Muni representatives agreed to a settlement of $140,000. Our client decided to accept the negotiated offer. However, the San Francisco Public Transportation Commission recommended against the settlement, hoping to lower the eventual amount. We took the case to trial and won a $210,000 jury verdict.
